4. Intellectual Property

All content on this website — including but not limited to text, graphics, logos, icons, and software — is the property of eSpark or its content suppliers and is protected by applicable intellectual property laws. Work product delivered to clients as part of a paid engagement is transferred to the client upon full payment, unless otherwise agreed in writing.

5. Payment & Refunds

Service fees are agreed upon before project commencement. All payments are due as specified in the project agreement. Refund eligibility is determined on a case-by-case basis and is subject to the following conditions:

• Refund requests must be submitted before work has begun.
• Partial refunds may be offered where work is partially completed.
• No refunds are issued for completed and delivered work unless a material defect is demonstrated.

6. Confidentiality

eSpark treats all client project information as strictly confidential. We do not share, disclose, or use your project details, data, or deliverables for any purpose other than completing your requested service, except where required by law.

7. Accuracy, Reliability & Warranty

eSpark is committed to delivering fully accurate and high-quality results on every project. Backed by years of hands-on expertise across AI engineering, digital marketing, education support, and technical design, our team of qualified professionals maintains a strong track record of precision and reliability.

All deliverables are produced in strict accordance with the scope, specifications, and requirements agreed upon at the start of each engagement. Within that defined scope, eSpark stands behind the accuracy and completeness of its work.

eSpark's warranty and reliability commitments are project-specific: we guarantee that deliverables meet the agreed requirements and will address any material deviation from those requirements at no additional cost. However, eSpark cannot be held responsible for outcomes arising from incomplete or inaccurate information provided by the client, changes in requirements after delivery, or use of deliverables beyond their intended purpose or scope.

8. Limitation of Liability

To the fullest extent permitted by law, eSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability to you for any claim shall not exceed the amount paid by you for the specific service giving rise to such claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable international laws. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration.
